Terms of Use

These Terms of Use ("Terms") govern your use of the CardAction mobile application and the cardaction.app website (together, the "Service"), operated by KRAFTPIXEL DIGITAL SOLUTIONS PRIVATE LIMITED under its consumer brand KraftPixel Labs ("we", "us"). By using the Service you agree to these Terms. For iOS users, Apple's Standard EULA also applies to the app download itself; where it conflicts with these Terms regarding Apple's requirements, the Apple EULA prevails.

1. The Service

CardAction scans paper business cards into digital contacts on your device, lets you create and share a digital business card ("My QR"), and offers optional exports (device contacts, files, Google Sheets, webhooks) and wallet passes (Apple Wallet / Google Wallet). Features may change, improve, or be discontinued over time.

2. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, in accordance with these Terms and the applicable app store rules. The Service, including its software, design, and branding, remains our intellectual property.

3. Your content and responsibilities

  • You are responsible for the accuracy and lawfulness of the information you scan, store, export, or place on your digital card, and for complying with applicable data-protection rules when handling other people's contact details.
  • You must not use the Service to send spam, harvest data unlawfully, misrepresent your identity, or infringe others' rights.
  • You retain ownership of your content. You grant us only the limited rights needed to operate the features you invoke (e.g., generating and updating a wallet pass from your card).

4. Subscriptions and purchases

  • Pro features are offered via auto-renewing subscriptions or one-time purchases processed by Apple's App Store or Google Play under their payment terms.
  • Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period, and are managed/cancelled in your app-store account settings.
  • Refunds are handled by the respective app store under its policies.
  • Free-tier limits, trials, and promotional access (including tester codes) may be modified or withdrawn at any time.

5. Wallet passes

CardAction can generate a digital pass version of the card you create for Apple Wallet and Google Wallet. You are solely responsible for the information you place on your card and for whom you share your pass with. Passes carry CardAction branding and may include links to our website and app-store listings. Automatically updating passes depend on Apple/Google infrastructure and our servers; we may modify, suspend, or discontinue pass generation or update delivery at any time. Removing a pass from all devices deletes its stored card data from our servers, as described in the Privacy Policy.

6. Third-party services

Optional integrations (Google Sheets, webhooks, WhatsApp links, wallet platforms) are provided by third parties under their own terms. We are not responsible for third-party services, their availability, or how they handle data you send to them.

7. Disclaimers

The Service is provided "as is" and "as available". Text recognition is automated and may contain errors — verify important details before relying on them. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.

8. Limitation of liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, or business, arising from your use of the Service. Our aggregate liability shall not exceed the amounts you paid us in the twelve months preceding the claim (or INR 1,000 if you paid nothing).

9. Termination

You may stop using the Service at any time; deleting the app removes your on-device data. We may suspend or terminate access for breach of these Terms. Sections that by their nature should survive (3, 7, 8, 10) survive termination.

10. Governing law

These Terms are governed by the laws of India, and courts at Mumbai, Maharashtra shall have exclusive jurisdiction, subject to any mandatory consumer protections of your place of residence.
